When the charges were filed, Chicago police alleged the black and openly gay Smollett — unhappy with his salary and hoping to promote his career — paid two brothers to stage what appeared to be a racist and homophobic attack, in which one of the men looped a rope fashioned as a noose around his neck.

Smollett’s attorneys filed a response Tuesday in federal court. It said the city should not be allowed to recover costs from Smollett because it accepted $10,000 from the actor “as payment in full in connection with the dismissal of the charges against him.”

“By mutual agreement, the studio has negotiated an extension to Jussie Smollett’s option for season six, but at this time there are no plans for the character of Jamal to return to ‘Empire,’” the studio said in a statement that gave no reasoning was given for the decision.

It also said Smollett wouldn’t be “intimidated” into paying anything.

Attorneys for “Empire” actor Jussie Smollett said Tuesday that charges alleging he lied to police about a racist and homophobic attack have been dropped.

Smollett has denied that he staged the attack and maintains he is innocent. His attorneys have called the charges against him “prosecutorial overkill.”

“Empire” Executive Producers Lee Daniels, Danny Strong, Brett Mahoney, Brian Grazer, Sanaa Hamri, Francie Calfo and Dennis Hammer released a statement saying Smollett’s character, Jamal, was being removed from the final two episodes of the season “to avoid further disruption on set.”

Police said Saturday that the investigation had “shifted” after detectives questioned two brothers about the attack and released them without charges. Police say they’ve requested a follow-up interview with Smollett.

The actor was attacked by two individuals screaming racial and homophobic slurs. They then proceeded to pour a chemical substance on him before placing a rope around his neck. Police said the alleged attackers then fled the scene. 

The city accuses Smollett of staging a racist and anti-gay attack against himself in January. It sued to force Smollett to pay $130,000 in police overtime and other expenses after state prosecutors dropped charges accusing him of filing a false report.

“You’ll see pictures of him in the background,” Collier said, without elaborating. He promised “surprises at the beginning of the season that you’re going to love.”

Smollett’s attorneys argue federal court is the proper venue for the case because the actor, who lived in Chicago while filming the TV show, “Empire,” is actually a California resident.

“This is about transparency and trust in the system and we believe the public has a right to know what the government did and why,” she said Thursday after the hearing.

A letter from the city’s legal department sent Thursday to Smollett and his attorneys said the figure covers overtime worked by more than two dozen detectives and officers who spent weeks looking into Smollett’s claim. The work included reviewing video and physical evidence and conducting interviews.
